This document sets out the terms and conditions between Wonder Women Tech Foundation and you when you purchase a ticket or register for any event or conference organized by Wonder Women Tech Foundation or participate in any survey of Wonder Women Tech Foundation’s. By purchasing a ticket or registering for an event or conference organized by Wonder Women Tech Foundation or participating in a survey you are agreeing to comply with and be bound by these terms and conditions. You should read this document carefully.

Wonder Women Tech Foundation reserves the right to change these terms and conditions at any time. Any amended terms and conditions will be posted on this website. Applicable from May 1, 2017.

CONFERENCE ORGANIZER

Wonder Women Tech Conference is being organized by Wonder Women Tech Foundation, a wholly American-owned qualified 501(c)(3) tax-exempt organization, which is in the main business of organizing diversity & inclusion in STEAM conferences and building conference related software.

DECLARATION OF CONSENT

I hereby give my consent for Wonder Women Tech Foundation (and its subsidiaries) to collect, process and use my personal data for the purposes of processing the purchase of my ticket and for any other use to which I have consented, including the importation of contact information for which I have provided my explicit prior consent.

This information will be used for the purposes of processing ticket sales and compiling attendee lists which may be published on our websites and across any relevant online portals, websites or platforms, and may be circulated by email to our email database, which includes all past and current attendees. It will also be used to improve our system for enhanced networking opportunities and tailored content. If you do not wish for your name, photograph, country where based and company name to appear on the attendee list please email info@wonderwomentech.com

PURCHASING TICKETS

I hereby give my consent for the mandatory and voluntary data collected from me in the course of purchasing and or registering for tickets sold by Wonder Women Tech Foundation (and/or other group companies). I further give my permission for my user account details to be stored. I acknowledge that I may provide Wonder Women Tech Foundation a reasonable timeframe to remove my details at any time that I no longer wish them to be stored. I acknowledge and accept that my data will be used for commercial purposes in accordance with this Data Protection Policy and Declaration of Consent and will be retained and stored for this purpose. Should you wish your data to be removed you must request Wonder Women Tech Foundation to do so in writing. Requests will be processed within a 30-day period.

ONLINE SURVEYS

I hereby give my consent for Wonder Women Tech Foundation to store any voluntary information I may provide in the course of participating in an online survey. I acknowledge and accept that my data will be used for commercial purposes in accordance with this Data Protection Policy and Declaration of Consent and will be retained and stored for this purpose.

TICKET REGISTRATION

I hereby give my consent for Wonder Women Tech Foundation to use for the purposes of processing complimentary or otherwise ticket registration the mandatory data and any voluntary data I provide when registering a complimentary admission ticket. I further give my consent for the voluntary data provided. I acknowledge and accept that my data will be used for commercial purposes in accordance with this Data Protection Policy and Declaration of Consent and will be retained and stored for this purpose.

SUBSIDIZED TICKETS

You cannot resell a subsidised ticket, including tickets from referral competitions, Day tickets, Event Volunteer tickets, Seniors 65+ tickets, Veterans and Active Military tickets, Persons with Disabilities, Deaf and hard of hearing tickets, Media & Press tickets and Speakers tickets, as doing so will void the ticket and the ticket holder will not gain entry into the event.

Our free and subsidized ticket offers sometimes include a processing fee. This fee is non-refundable in its entirety.

If you have secured a complimentary ticket but have already bought a ticket, you are not eligible for a refund.

FREE TICKETS

In our efforts to even the age diversity, generational diversity, physical and neurodiversity ratio at our events, we offer free and subsidized Seniors 65+ tickets, Persons with Disabilities, Deaf & Hard of hearing tickets, Veterans & Active MIlitary tickets to our conferences from time to time. It is a strict condition of these promotions that only said attendees can gain admission to the event with proof of I.D. using these tickets.

All tickets must be assigned to an attendee, and all attendee details must be 100% complete within 30 days of receipt of your ticket. For the avoidance of doubt, this includes a confirmation of your Eventbrite profile. Ticket reassignment after this date is prohibited.

These tickets cannot be sold, and are non-transferable within 30 days of purchase.

WONDER WOMEN TECH DAY TICKETS

In our efforts to allow young people to attend our events, we offer free and subsidized Day Tickets to our conferences from time to time. It is a strict condition of these promotions that only individuals aged from 13-17 can gain admission to the event using these tickets.

Any person redeeming a Wonder Women Tech Day Ticket must provide relevant identification, such as a student I.D.

No name changes for Wonder Women Tech Day Tickets will be facilitated prior to the commencement of the event.

EVENT INFORMATION

I acknowledge that Wonder Women Tech Foundation will not provide transport or travel expenses to or from any event or conference. I acknowledge that Wonder Women Tech Foundation will consider but not guarantee exhibitors’ and speakers’ requests for day changes at any event or conference.

ADD-ONS

All items (screens, laptops, cabling and other electronic equipment, rooms, furniture etc.) supplied are on a rental basis and no exchange, transfer or refund of ordered items on-site will be entertained.

Exhibitors must pay for any damages or losses caused to items supplied to them.

Cancelled orders are not refundable.

Non-standard items may be offered on request, subject to a separate quotation, and are subject to the same terms and conditions.

Any complaint regarding rental items or installation must be lodged before the opening of the event. In respect of items rented on the day, items should be inspected immediately and tested to ensure they work. Otherwise all items are deemed to be received in good order and condition.

The equipment must be insured “all risk” by the hirer, who will remain liable until the authorized staff has collected the equipment.
In case of disappearance, the equipment will be invoiced at the original insurance value.

VOLUNTEERS

By agreeing to act as a volunteer at an event, I acknowledge that:

  • I will receive no compensation for travel, accommodation etc.
  • There is no guarantee that I will be selected to be a volunteer at the event.
  • If I violate any event rule or fail to show up for an assigned shift, my accreditation can be removed and I will be denied access to the event.
  • I attest to the truth of all statements made in my application.
  • The use of alcohol and/or controlled substances before or while on duty is strictly prohibited. Violation of this policy will result in immediate dismissal, removal of accreditation and removal from the event grounds.
  • Selection as a volunteer grants permission to Wonder Women Tech Foundation, or other group companies, to use the volunteer likeness, name, voice and words in television, radio, film, newspapers, magazines and other media, both during and anytime after the event, and in any form, for advertising or communicating the purpose of the event(s).
  • In the course of the event I may be dealing with confidential information and I agree to keep such information in the strictest of confidence.
  • I have read and fully understood these terms and conditions.

USE OF PERSONAL DATA FOR ADVERTISING PURPOSES

Wonder Women Tech Foundation will not share your address, e-mail address, credit card information or personal information to any third party without your permission. I hereby give my consent for Wonder Women Tech Foundation (and subsidiaries) to store the following types of data as a profile for internal purposes:

  • Mandatory and voluntary data collected when purchasing tickets.
  • Mandatory and voluntary data collected when registering a complimentary admission ticket as well as the date of the ticket registration.
  • Voluntary disclosures when participating in online surveys.
  • If I have opted-in to receive email communication about related events I give consent for Wonder Women Tech Foundation or subsidiary companies to analyse and use the data for the purpose of targeted advertising communications to me on relevant topics and products in connection with Wonder Women Tech Foundation or subsidiary events and promotions.
  • Data collected from any connected social media for which I have provided my explicit prior consent.
  • If I have provided my mobile telephone number I consent to Wonder Women Tech Foundation or subsidiary companies to contact me by SMS in relation to events for which I am purchasing a ticket or registering an expression of interest.
  • I furthermore consent to the mathematical and statistical analysis of my personal data for advertising purposes (scoring). However, my e-mail address may be used for advertising purposes only with my express consent.
  • I also give my consent for my data to be updated and supplemented with additional data.
  • Accordingly, I give my consent for Wonder Women Tech Foundation (and subsidiaries) to collect data relating to me personally from public domain sources and to store these along with my personal data that are already under the control of Wonder Women Tech Foundation (and subsidiaries). I give my consent for Wonder Women Tech Foundation (and subsidiaries) to analyse this newly collected data together with the data already under their control and to use the same for the purpose of targeted advertising communications to me on relevant topics and products in connection with trade fairs and/or exhibitors of interest.
  • I furthermore consent to the imported contact data being used for the purposes of improving our system for enhanced networking opportunities and tailored content.
  • Wonder Women Tech Foundation has free lifetime use of any image or video content created by attendees at Wonder Women Tech Conferences (and any other events organised by WWT).

Personal information

When personal information (e.g. name, e-mail address, work address, phone numbers and other contact information) is provided through the Wonder Women Tech website or directly to us by e-mail you give consent to Wonder Women Tech Foundation for:

  • Processing and administering your personal data to perform all necessary actions to give effect to your request or instructions
  • Retaining a record of incoming and outgoing communications (e.g. email) to process your personal data as outlined in this Privacy Statement.

Wonder Women Tech Foundation may also collect the following information about you:

  • Information that you provide by filling in forms on our site.
  • Name and physical shipping, contact and payment addresses.
  • Email address and telephone numbers
  • Credit card, debit card or bank information.
  • Date of birth
  • Tax identification or VAT number (if applicable)
  • Social Media profiles, e.g. Facebook, Twitter, Linkedin

If you contact us we may keep a record of that correspondence.

Information we receive from credit reference and fraud detection agencies or other third parties we may use to verify your information. We may ask you to complete surveys for research purposes, although you do not have to respond to them.

Right of Access

You have a right to be given a copy of any of your personal data held by Wonder Women Tech Foundation in accordance with section 4 of the Data Protection Acts subject to certain exceptions. Requests for a copy of your personal data can be emailed to info@wonderwomentech.com or addressed to: Wonder Women Tech Foundation, 100 W Broadway Suite 3000, Long Beach, CA 90802.

Right of rectification or erasure

If Wonder Women Tech Foundation hold incorrect information about you which was originally submitted by you through this website, you have the right to have the data amended. Further, you have the right to have any information you have sent to us via this website erased. To request your right to rectification and/or erasure please send your request to info@wonderwomentech.com or in writing to: Wonder Women Tech Foundation, 100 W Broadway Suite 3000, Long Beach, CA 90802.

Requests should include:

  • Your name and address.
  • A description of the specific personal data you wish rectified.

Please note that Wonder Women Tech Foundation is not required to rectify or erase your data where doing so would prevent you from meeting your contractual obligations to Wonder Women Tech Foundation or where Wonder Women Tech Foundation is required to process (including retaining) your personal data for a lawful purpose in accordance with the Data Protection Acts. In the event of any conflict between these terms and the provisions of the Data Protection Acts, the Data Protection Acts shall prevail.

Security

The security of your Personal Information is important to us. However, no method of transmission over the Internet, or method of electronic storage, is 100% secure. Therefore, while we strive to use commercially acceptable means to protect your Personal Information, Wonder Women Tech Foundation cannot guarantee its absolute security and cannot accept any liability where the security of your Personal Information is compromised. The security of your personal information is important to us. When you enter sensitive information (such as credit card number) on our registration or order forms, we encrypt that information using secure socket layer technology (TLS/SSL).

Changes to this Policy

Wonder Women Tech Foundation reserves the right to modify this Data Protection Policy and Declaration of Consent at any time. Any changes will be posted on our homepage and other places we deem appropriate so that you are aware of the changes.

REFUND AND CANCELLATION POLICY

All purchases of tickets for conferences and events (including hotel rooms if applicable) are non-refundable in their entirety. Any Refund Processed (if applicable) is subject to US$10 transaction fee. Your ticket remains the property of Wonder Women Tech Foundation and is a personal revocable license, which may be withdrawn, and admission refused at any time upon a refund of the printed registration price.

In the unlikely event of cancellation of a conference or event the liability of Wonder Women Tech Foundation is limited to the share of paid registration fees that remains after credit card and payment processing fees have been incurred and deducted.

It is strictly forbidden for any company, organization or attendee to attempt to host or organize any event in conjunction with, contiguous to or purporting to be related to Wonder Women Tech Conference or its affiliates without the express prior permission and co-operation of Wonder Women Tech Foundation. In the event of breach of these terms any tickets purchased will be rendered null and void. Wonder Women Tech Foundation reserves their right to take such legal action including a claim for damages as may be appropriate.

The tickets purchased (including hotel rooms if applicable) are for your own personal use or that of your business only and may not be re-sold or transferred for commercial gain under any circumstances, including but not limited to use as part of any promotion or competition. Where there has been any re-sale or attempted re-sale of any tickets (or any other breach of this term), we reserve the right to cancel the relevant tickets with immediate effect.

We reserve the right to cancel any ticket purchase made by any person or body whom we reasonably believe to be associated with any ticket broker or tout.

Wonder Women Tech Foundation reserves the right to refuse admission to any event or conference for any behavior, which it deems unacceptable, or for breach of the terms and conditions.

Wonder Women Tech Foundation will not be responsible for any tickets that are lost or stolen. The unauthorized use of photographic and recording equipment at events and conferences is prohibited. You consent to film and sound recording as attendees at any event or conference.

Wonder Women Tech Foundation and its subsidiaries will not be liable for any loss injury or damage to any person or property howsoever caused (save for death or personal injury as a result of Wonder Women Tech Foundation’s negligence or for any other type of liability that cannot by law be excluded or limited.)

Wonder Women Tech Foundation will not be liable for the granting of any visas that are required to attend any event or conference. In the event that an attendee’s visa is not granted tickets will not be refunded for any event or conference.

If an individual seeks a refund on general attendee tickets that were purchased before their exhibitor ticket was purchased, Wonder Women Tech Foundation will not grant a full refund when the general attendee ticket price has increased beyond the startup ticket price.

Name changes will be facilitated free of charge. No name changes will be facilitated 7 days prior to the commencement of the event and the ticket price will be forfeited.

If you have been selected to volunteer at the event but have already bought a ticket, you are not eligible for a refund.

COMPLAINTS

Complaints can be made to info@wonderwomentech.com. We will endeavor to resolve any customer complaints where reasonable.

EVENT CANCELLATION, POSTPONEMENT & SUBSTITUTION POLICY

Wonder Women Tech Foundation is not responsible for any loss or damage as a result of a substitution, alteration, cancellation or postponement of an event. Wonder Women Tech Foundation shall assume no liability whatsoever in the circumstances that an event is cancelled, rescheduled or postponed due to a fortuitous event, Act of God, unforeseen occurrence or any other event that renders performance of an event impracticable, illegal or impossible. For purposes of this clause, a fortuitous event shall include, but not be limited to: war, fire, labour strike, extreme weather or other emergency.

Please note that while speakers and topics are confirmed at the time of publishing, circumstances beyond the control of the organizers may necessitate substitutions, alterations or cancellations of the speakers and/or topics. As such, Wonder Women Tech Foundation reserves the right to alter or modify the advertised speakers and/or topics if necessary without any liability to you whatsoever. Any substitutions or alterations will be updated on our web page as soon as possible.

Delivery Policy

Once a successful purchase transaction has been completed, tickets are delivered in electronic soft-copy via email to the email address nominated by the purchaser. For some ticket types it may be necessary to complete required information – such as attendee name or tax identification number – before the tickets can be issued. The ticket acts as a receipt for the transaction and can be used to redeem entry at the event listed on the ticket. A printed hard-copy ticket or an electronic soft-copy ticket detailing the confirmation number can be used to register at the event. State of California law governs these terms and conditions and any dispute is subject to the exclusive jurisdiction of the State of California Courts.

ATTENDEES UNDER AGE 18

Attendees under the age of 18 must be accompanied by an adult chaperone up until the point of conference registration/accreditation collection.
Chaperones are not required to attend the conference provided their youth attendee(s) is/are aged 16 or over but are welcome to do so provided they purchase a valid ticket.
Chaperones must make themselves known, in person and with valid identification, to conference staff in the presence of the youth attendee at the point of registration/accreditation collection.
Chaperones must provide valid contact information for the duration of the conference.
The conference may require documentation for the authorization of the youth’s attendance prior to registration/accreditation collection.
These documents include, but are not limited to, the following: copy of passport or other identification for both the youth and the chaperone(s), copy of the youth’s birth certificate, notarised letter of consent signed by both parents or legal guardian (or by a single parent with accompanying proof of sole custody).
Wonder Women Tech Foundation reserves the right to refuse admission to anyone who fails to comply with these documentation requirements.
Children under the age of 3 will be admitted free of charge provided they are accompanied by a parent or legal guardian.
The conference is not responsible for any requirements associated with travel to or from the conference location.
Please check with individual airlines and other agents of travel, as rules vary.
Many hotels require any guest under the age of 18 to be accompanied by an adult.
Chaperones may be required to stay in the hotel room with the youth and may be required to be primarily responsible for the booking of that room.

3 and under: chaperone for duration of event; no ticket required for youth
3 – 12: chaperone for duration of event; ticket required for youth and chaperone
13 – 17: guardian permission at reg; ticket required for youth only
18 +: ticket required
*Date of birth prior to date of accreditation collection

Terms of Use

PLEASE READ THE FOLLOWING TERMS OF USE AGREEMENT CAREFULLY. BY ACCESSING OR USING OUR SITES AND OUR SERVICES, YOU HEREBY AGREE TO BE BOUND BY THE TERMS AND ALL TERMS INCORPORATED HEREIN BY REFERENCE. IF YOU DO NOT EXPRESSLY AGREE TO ALL OF THE TERMS AND CONDITIONS, THEN PLEASE DO NOT ACCESS OR USE OUR SITES OR OUR SERVICES. THIS TERMS OF SERVICE AGREEMENT IS EFFECTIVE AS OF 10/16/2015.

ACCEPTANCE OF TERMS

The following Terms of Service Agreement (the “TOS”) is a legally binding agreement that shall govern the relationship with our users and others which may interact or interface with Wonder Women Tech Foundation, also known as Wonder Women Tech and Wonder Women Tech Conference, located at 235 E Broadway, 8th Floor, Long Beach, California 90802, and our subsidiaries and affiliates, in association with the use of the Wonder Women Tech Foundation website, which includes www.wonderwomentech.com (the “Site”) and its Services, which shall be defined below.

DESCRIPTION OF WEBSITE SERVICES OFFERED

The Site is a news and information website which has the following description:

To spread the word about Wonder Women Tech (WWT), a conference franchise and series of educational programming that highlights, celebrates and educates women in STEAM, (Science, Technology, Engineering, Arts & Mathematics) and innovation. Our platform offers a variety of speakers, panel discussions, coding classes, hackathons and other dynamic initiatives geared towards empowering women and girls and educating our male counterparts.

Any and all visitors to our site shall be deemed as “users” of the herein contained Services provided for the purpose of this TOS.

The user acknowledges and agrees that the Services provided and made available through our website and applications, which may include some mobile applications and that those applications may be made available on various social media networking sites and numerous other platforms and downloadable programs, are the sole property of Wonder Women Tech Foundation. At its discretion, Wonder Women Tech Foundation may offer additional website Services and/or products, or update, modify or revise any current content and Services, and this Agreement shall apply to any and all additional Services and/or products and any and all updated, modified or revised Services unless otherwise stipulated. Wonder Women Tech Foundation does hereby reserve the right to cancel and cease offering any of the aforementioned Services and/or products. You, as the end user , acknowledge, accept and agree that Wonder Women Tech Foundation shall not be held liable for any such updates, modifications, revisions, suspensions or discontinuance of any of our Services and/or products. Your continued use of the Services provided, after such posting of any updates, changes, and/or modifications shall constitute your acceptance of such updates, changes and/or modifications, and as such, frequent review of this Agreement and any and all applicable terms and policies should be made by you to ensure you are aware of all terms and policies currently in effect. Should you not agree to the updated, modified, revised or modified terms, you must stop using the provided Services.

Furthermore, the user understands, acknowledges and agrees that the Services offered shall be provided “AS IS” and as such Wonder Women Tech Foundation shall not assume any responsibility or obligation for the timeliness, missed delivery, deletion and/or any failure to store user content, communication or personalization settings.

CAUTIONS FOR GLOBAL USE AND EXPORT AND IMPORT COMPLIANCE

Due to the global nature of the internet, through the use of our network you hereby agree to comply with all local rules relating to online conduct and that which is considered acceptable Content. Uploading, posting and/or transferring of software, technology and other technical data may be subject to the export and import laws of the United States and possibly other countries. Through the use of our network, you thus agree to comply with all applicable export and import laws, statutes and regulations, including, but not limited to, the Export Administration Regulations (http://www.access.gpo.gov/bis/ear/ear_data.html), as well as the sanctions control program of the United States (http://www.treasury.gov/resource-center/sanctions/Programs/Pages/Programs.aspx). Furthermore, you state and pledge that you:

a) are not on the list of prohibited individuals which may be identified on any government export exclusion report (http://www.bis.doc.gov/complianceandenforcement/liststocheck.htm) nor a member of any other government which may be part of an export-prohibited country identified in applicable export and import laws and regulations;

b) agree not to transfer any software, technology or any other technical data through the use of our network Services to any export-prohibited country;

c) agree not to use our website network Services for any military, nuclear, missile, chemical or biological weaponry end uses that would be a violation of the U.S. export laws; and

d) agree not to post, transfer nor upload any software, technology or any other technical data which would be in violation of the U.S. or other applicable export and/or import laws.

CONTENT PLACED OR MADE AVAILABLE FOR COMPANY SERVICES

Wonder Women Tech Foundation shall not lay claim to ownership of any content submitted by any visitor or user, or make such content available for inclusion on our website Services. Therefore, you hereby grant and allow for Wonder Women Tech Foundation the below listed worldwide, royalty-free and non-exclusive licenses, as applicable:

a) The content submitted or made available for inclusion on the publicly accessible areas of Wonder Women Tech Foundation’s sites, the license provided to permit to use, distribute, reproduce, modify, adapt, publicly perform and/or publicly display said Content on our network Services is for the sole purpose of providing and promoting the specific area to which this content was placed and/or made available for viewing. This license shall be available so long as you are a member of Wonder Women Tech Foundation’s sites, and shall terminate at such time when you elect to discontinue your membership.

b) Photos, audio, video and/or graphics submitted or made available for inclusion on the publicly accessible areas of Wonder Women Tech Foundation’s sites, the license provided to permit to use, distribute, reproduce, modify, adapt, publicly perform and/or publicly display said Content on our network Services are for the sole purpose of providing and promoting the specific area in which this content was placed and/or made available for viewing. This license shall be available so long as you are a member of Wonder Women Tech Foundation’s sites and shall terminate at such time when you elect to discontinue your membership.

c) For any other content submitted or made available for inclusion on the publicly accessible areas of Wonder Women Tech Foundation’s sites, the continuous, binding and completely sub-licensable license which is meant to permit to use, distribute, reproduce, modify, adapt, publish, translate, publicly perform and/or publicly display said content, whether in whole or in part, and the incorporation of any such Content into other works in any arrangement or medium current used or later developed.

Those areas which may be deemed “publicly accessible” areas of Wonder Women Tech Foundation’s sites are those such areas of our network properties which are meant to be available to the general public, and which would include message boards and groups that are openly available to visitors .

CONTRIBUTIONS TO COMPANY WEBSITE

Wonder Women Tech Foundation provides an area for our users to contribute feedback to our website. When you submit ideas, documents, suggestions and/or proposals (“Contributions”) to our site, you acknowledge and agree that:

a) your Contributions do not contain any type of confidential or proprietary information;

b) Wonder Women Tech Foundation shall not be liable or under any obligation to ensure or maintain confidentiality, expressed or implied, related to any Contributions;

c) Wonder Women Tech Foundation shall be entitled to make use of and/or disclose any such Contributions in any such manner as they may see fit;

d) the contributor’s Contributions shall automatically become the sole property of Wonder Women Tech Foundation; and

e) Wonder Women Tech Foundation is under no obligation to either compensate or provide any form of reimbursement in any manner or nature.

INDEMNITY

All users herein agree to insure and hold Wonder Women Tech Foundation, our subsidiaries, affiliates, agents, employees, officers, partners and/or licensors blameless or not liable for any claim or demand, which may include, but is not limited to, reasonable attorney fees made by any third party, which may arise from any content a user of our site may submit, post, modify, transmit or otherwise make available through our Services, the use of Wonder Women Tech Foundation Services or your connection with these Services, your violations of the Terms of Service and/or your violation of any such rights of another person.

COMMERCIAL REUSE OF SERVICES

The user herein agrees not to replicate, duplicate, copy, trade, sell, resell nor exploit for any commercial reason any part, use of, or access to Wonder Women Tech Foundation’s sites.

MODIFICATIONS

PROPRIETARY RIGHTS

You do hereby acknowledge and agree that Wonder Women Tech Foundation’s Services and any essential software that may be used in connection with our Services (“Software”) shall contain proprietary and confidential material that is protected by applicable intellectual property rights and other laws. Furthermore, you herein acknowledge and agree that any Content which may be contained in any advertisements or information presented by and through our Services or by advertisers is protected by copyrights, trademarks, patents or other proprietary rights and laws. Therefore, except for that which is expressly permitted by applicable law or as authorized by Wonder Women Tech Foundation or such applicable licensor, you agree not to alter, modify, lease, rent, loan, sell, distribute, transmit, broadcast, publicly perform and/or created any plagiaristic works which are based on Wonder Women Tech Foundation Services (e.g. Content or Software), in whole or part.

Wonder Women Tech Foundation herein has granted you personal, non-transferable and non-exclusive rights and/or license to make use of the object code or our Software on a single computer, as long as you do not, and shall not, allow any third party to duplicate, alter, modify, create or plagiarize work from, reverse engineer, reverse assemble or otherwise make an attempt to locate or discern any source code, sell, assign, sublicense, grant a security interest in and/or otherwise transfer any such right in the Software. Furthermore, you do herein agree not to alter or change the Software in any manner, nature or form, and as such, not to use any modified versions of the Software, including and without limitation, for the purpose of obtaining unauthorized access to our Services. Lastly, you also agree not to access or attempt to access our Services through any means other than through the interface which is provided by WeLabs for use in accessing our Services.

b) WONDER WOMEN TECH FOUNDATION AND OUR SUBSIDIARIES, OFFICERS, EMPLOYEES, AGENTS, PARTNERS AND LICESNSORS MAKE NO SUCH WARRANTIES THAT (i) WONDER WOMEN TECH FOUNDATION SERVICES OR SOFTWARE WILL MEET YOUR REQUIREMENTS; (ii) WONDER WOMEN TECH FOUNDATION SERVICES OR SOFTWARE SHALL BE UNINTERRUPTED, TIMELY, SECURE OR ERROR-FREE; (iii) THAT SUCH RESULTS WHICH MAY BE OBTAINED FROM THE USE OF THE WONDER WOMEN TECH FOUNDATION SERVICES OR SOFTWARE WILL BE ACCURATE OR RELIABLE; (iv) QUALITY OF ANY PRODUCTS, SERVICES, ANY INFORMATION OR OTHER MATERIAL WHICH MAY BE PURCHASED OR OBTAINED BY YOU THROUGH OUR SERVICES OR SOFTWARE WILL MEET YOUR EXPECTATIONS; AND (v) THAT ANY SUCH ERRORS CONTAINED IN THE SOFTWARE SHALL BE CORRECTED.

c) ANY INFORMATION OR MATERIAL DOWNLOADED OR OTHERWISE OBTAIN BY WAY OF WELABS SERVICES OR SOFTWARE SHALL BE ACCESSED BY YOUR SOLE DISCRETION AND SOLE RISK, AND AS SUCH YOU SHALL BE SOLELY RESPONSIBLE FOR AND HEREBY WAIVE ANY AND ALL CLAIMS AND CAUSES OF ACTION WITH RESPECT TO ANY DAMAGE TO YOUR COMPUTER AND/OR INTERNET ACCESS, DOWNLOADING AND/OR DISPLAYING, OR FOR ANY LOSS OF DATA THAT COULD RESULT FROM THE DOWNLOAD OF ANY SUCH INFORMATION OR MATERIAL.

d) NO ADVICE AND/OR INFORMATION, DESPITE WETHER WRITTEN OR ORAL, THAT MAY BE OBTAINED BY YOU FROM WONDER WOMEN TECH FOUNDATION OR BY WAY OF OR FROM OUR SERVICES OR SOFTWARE SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THE TOS.

e) A SMALL PERCENTAGE OF SOME USERS MAY EXPERIENCE SOME DEGREE OF EPILEPTIC SEIZURE WHEN EXPOSED TO CERTAIN LIGHT PATTERNS OR BACKGROUNDS THAT MAY BE CONTAINED ON A COMPUTER SCREEN OR WHILE USING OUR SERVICES. CERTAIN CONDITIONS MAY INDUCE A PREVIOUSLY UNKNOWN CONDITION OR UNDETECTED ELILEPTIC SYMPTOM IN USERS WHO HAVE SHOWN NO HISTORY OF ANY PRIOR SEIZURE OR EPILEPSY. SHOULD YOU, ANYONE YOU KNOW OR ANYONE IN YOUR FAMILY HAVE AN EPILEPTIC CONDITION, PLEASE CONSULT A PHYSICAN IF YOU EXPERIENCE ANY OF THE FOLLOWING SYMPTOMS WHILE USING OUR SERVICES: DIZZINESS, ALTERED VISON, EYE OR MUSCLE TWITCHES, LOSS OF AWARNESS, DISORIENTATION, ANY INVOLUNTARY MOVEMENT, OR CONVULSIONS.

LIMITATION OF LIABILITY
YOU EXPLICITY ACKNOWLEDGE, UNDERSTAND AND AGREE THAT WELABS AND OUR SUBISDIARIES, AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, PARTNERS AND LICENSORS SHALL NOT BE LIABLE TO YOU FOR ANY PUNITIVE, INDIRECT, INCIDENTIAL, SPECIAL, CONSEQUENIAL OR EXEMPLARY DAMAGES, INCLUDING, BUT NOT LIMITED TO, DAMAGES WHICH MAY BE RELATED TO THE LOSS OF ANY PROFITS, GOODWILL, USE, DATA AND/OR OTHER INTANGILBE LOSSES, EVEN THOUGH WE MAY HAVE BEEN ADVISED OF SUCH POSSIBILITY THAT SAID DAMAGES MAY OCCUR, AND RESULT FROM:

a) THE USE OR INABILITY TO USE OUR SERVICE;

b) THE COST OF PRECURING SUBSTITUTE GOODS AND SERVICES;

Wonder Women Tech Foundation will always respect the intellectual property of others, and we ask that all of our users to the same. With regards to appropriate circumstances and at its sole discretion, Wonder Women Tech Foundation may disable and/or terminate the accounts of any user who repeatedly violates our TOS and/or infringes the rights of others. If you feel that your work has been duplicated in such a way that would constitute copyright infringement, or if you believe your intellectual property rights have been otherwise violated, you should provide to us the following information:

a) The electronic or the physical signature of the individual that is authorized on behalf of the owner of the copyright or other intellectual property interest;

GENERAL INFORMATION

 

ENTIRE AGREEMENT

This TOS constitutes the entire agreement between you and Wonder Women Tech Foundation and shall govern the use of our Services, superseding any prior version of this TOS between you and us with respect to Wonder Women Tech Foundation Services. You may also be subject to additional terms and conditions that may apply when you use or purchase certain other Wonder Women Tech Foundation Services, affiliate Services, third-party content or third-party software.

CHOICE OF LAW AND FORUM

It is at the mutual agreement of both you and Wonder Women Tech Foundation with regard to the TOS that the relationship between the parties shall be governed by the laws of the state of California without regard to its conflict of law provisions and that any and all claims, causes of action and/or disputes, arising out of or relating to the TOS, or the relationship between you and Wonder Women Tech Foundation, shall be filed within the courts having jurisdiction within the County of Los Angeles County, California or the U.S. District Court located in said state. You and Wonder Women Tech Foundation agree to submit to the jurisdiction of the courts as previously mentioned, and agree to waive any and all objections to the exercise of jurisdiction over the parties by such courts and to venue in such courts.

WAIVER AND SEVERABILITY OF TERMS

At any time, should Wonder Women Tech Foundation fail to exercise or enforce any right or provision of the TOS, such failure shall not constitute a waiver of such right or provision. If any provision of this TOS is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties’ intentions as reflected in the provision, and the other provisions of the TOS remain in full force and effect.

STATUTE OF LIMITATIONS

You acknowledge, understand and agree that regardless of any statute or law to the contrary, any claim or action arising out of or related to the use of our Services or the TOS must be filed within 1 year(s) after said claim or cause of action arose or shall be forever barred.
